Agreement to Terms
By accessing or using tundra-ibis services, including our website and educational courses, you agree to be bound by these Terms of Use and all applicable laws and regulations. If you do not agree with any part of these terms, you may not use our services.
Eligibility
Our services are intended for individuals aged 18 years or older. By using our services, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into this agreement.
If you are accessing our services on behalf of an organization, you represent that you have authority to bind that organization to these terms.
Account Registration and Security
To access certain features and course materials, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information
- Maintain the security and confidentiality of your login credentials
- Notify us immediately of any unauthorized access to your account
- Accept responsibility for all activities that occur under your account
You may not share your account credentials with others or allow others to access course materials using your account. We reserve the right to suspend or terminate accounts that violate this provision.
Course Enrollment and Access
Enrollment Process
Course enrollment becomes effective upon our acceptance of your registration and receipt of payment. We reserve the right to refuse enrollment for any reason.
Access Period
Upon successful enrollment, you receive twelve months of access to course materials from the date access credentials are provided. Access periods are not extended for periods of non-use.
Course Content
Course content, structure, and instructors may change at our discretion. We strive to notify enrolled students of significant changes but are not obligated to maintain specific content or instructors throughout the access period.
Payment Terms
Pricing
Course prices are listed in British Pounds (GBP) and are subject to change. The price applicable to your enrollment is the price displayed at the time you complete the enrollment process.
Payment Processing
Payments are processed through secure third-party payment processors. You agree to provide accurate payment information and authorize us to charge the applicable fees to your payment method.
Refund Policy
We offer refunds within 14 days of enrollment if you have accessed less than 20% of course materials. Refund requests must be submitted via email to [email protected]. Approved refunds are processed within 10 business days.
After 14 days or after accessing more than 20% of materials, enrollments are non-refundable. Access periods are not paused or extended for any reason, including technical issues on your end or changes in personal circumstances.
Intellectual Property Rights
Our Content
All content provided through our services, including but not limited to text, videos, images, graphics, code examples, exercises, and course materials, are owned by or licensed to tundra-ibis and protected by intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to access and use course materials solely for your personal educational purposes during the access period. This license does not permit you to:
- Copy, reproduce, or distribute course materials
- Create derivative works based on our content
- Sell, rent, lease, or sublicense access to materials
- Remove or alter any copyright, trademark, or proprietary notices
- Use materials for commercial purposes
- Share access credentials or allow others to access materials through your account
Student Work
You retain ownership of work you create as part of course exercises. By submitting work for instructor feedback, you grant us a non-exclusive license to review, reproduce, and store your submissions for educational and assessment purposes.
Acceptable Use Policy
You agree not to:
- Violate any applicable laws or regulations
- Infringe on intellectual property rights of others
- Transmit harmful code, viruses, or malicious software
- Attempt to gain unauthorized access to our systems or other users' accounts
- Interfere with or disrupt the operation of our services
- Engage in any activity that could damage, disable, or impair our infrastructure
- Use automated systems to access services in ways that send more requests than a human could reasonably produce
- Collect or harvest personal information about other users
- Impersonate any person or entity or misrepresent your affiliation
- Post or transmit content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
Community Standards
Our student forum and communication channels are provided to facilitate learning and professional networking. You agree to:
- Treat other users with respect and professionalism
- Keep discussions relevant to software testing and quality assurance
- Respect confidentiality and not share others' personal information
- Not use forums for commercial solicitation or spam
- Not post content that violates intellectual property rights
We reserve the right to remove content and suspend or terminate access for users who violate community standards.
Disclaimers and Limitations of Liability
Educational Nature
Our courses provide educational content and training. We do not guarantee specific learning outcomes, employment opportunities, salary increases, or career advancement. Professional success depends on many factors beyond educational training.
Service Availability
We strive to maintain reliable access to our services but do not guarantee uninterrupted availability. Services may be temporarily unavailable due to maintenance, updates, technical issues, or circumstances beyond our control.
No Warranties
Our services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
Limitation of Liability
To the maximum extent permitted by law, tundra-ibis and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:
- Your use or inability to use our services
- Any unauthorized access to or use of our servers or any personal information stored therein
- Any interruption or cessation of services
- Any bugs, viruses, or other harmful code transmitted through our services
- Any errors or omissions in content or any loss or damage incurred as a result of using content
Our total liability for any claims arising from or related to these terms or our services shall not exceed the amount you paid us in the 12 months preceding the claim.
Indemnification
You agree to indemnify, defend, and hold harmless tundra-ibis and its affiliates, officers, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising from:
- Your use of our services
- Your violation of these terms
- Your violation of any rights of another party
- Your violation of any applicable laws or regulations
Termination
We reserve the right to suspend or terminate your access to services at any time, with or without notice, for conduct that we believe violates these terms, is harmful to other users, or is otherwise inappropriate.
Upon termination, your right to access course materials ceases immediately. Provisions of these terms that by their nature should survive termination shall survive, including intellectual property rights, disclaimers, limitations of liability, and dispute resolution provisions.
Modifications to Terms
We may modify these Terms of Use at any time by posting updated terms on our website. Material changes will be communicated via email to registered users. Your continued use of services after changes become effective constitutes acceptance of the updated terms.
If you do not agree to modified terms, you should discontinue use of our services. For enrolled students, modifications do not affect terms applicable to your enrollment that were in effect at the time of enrollment regarding refund policy and access period.
Governing Law and Dispute Resolution
These terms are governed by the laws of England and Wales, without regard to conflict of law principles.
Any disputes arising from or relating to these terms or our services shall be resolved through binding arbitration in accordance with the rules of the relevant arbitration authority, conducted in English in Bristol, United Kingdom. You waive any right to participate in class action lawsuits or class-wide arbitration.
Nothing in this section prevents either party from seeking injunctive or equitable relief in court to protect intellectual property rights or prevent misuse of services.
General Provisions
Entire Agreement
These terms, together with our Privacy Policy and any other legal notices published on our website, constitute the entire agreement between you and tundra-ibis regarding our services.
Severability
If any provision of these terms is found to be invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
Waiver
Our failure to enforce any right or provision of these terms shall not constitute a waiver of that right or provision.
Assignment
You may not assign or transfer these terms or your rights under them without our prior written consent. We may assign these terms without restriction.
